Privacy Policy

This privacy policy explains how nomos system AG handles the personal data that we collect from you when you use our website.

General information:

In cooperation with our hosting providers, we make every effort to protect the databases as well as possible against unauthorized access, loss, misuse or falsification.

We would like to point out that data transmission over the internet (e.g. when communicating by email) may have security vulnerabilities. It is not possible to provide seamless protection of data from access by third parties.

By using this website, you consent to the collection, processing and use of data as described below. It is generally possible to visit this website without registering. Data such as pages viewed or the name of the file viewed, date and time are stored on the server for statistical purposes without this data being directly linked to your person. Where personal data (e.g. name, address or e-mail addresses) is collected on our pages, this is done, as far as possible, on a voluntary basis. This data will not be passed on to third parties without your express consent.

What data do we collect?

Personal data means any information relating to an identified or identifiable natural person. A data subject is a natural person whose personal data is processed. Processing comprises any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

nomos system AG collects the following data:

  • IP address and country of origin
  • First name, last name, and email address when registering for a nomos cloud account
  • Pairing information of services/devices connected to the nomos cloud account
  • Serial number of the nomos controller for remote access
  • Push device ID and email address for push and email notifications
  • Telemetry data
  • Remote IP

Why do we collect your data?

  • When you register for a nomos cloud account, we collect your email address, name, and last name. This information is essential for the effective administration of your account. You have the option to remove yourself from this panel, although direct downloads of your personal data is not currently supported but will be integrated soon.
  • When you link your nomos Cloud account to your nomos controller, we store this pairing information. This is necessary for integration with services like Alexa, Google Assistant or IFTTT.
  • We store the serial number of the controller to enable remote access to it.
  • Push or email notifications are processed in our cloud services for delivery, but are not stored anywhere.
  • Telemetry data is stored for diagnostic purposes in the event of crashes and errors, to optimize performance and to improve functions.
  • To enable VPN, we store the serial number and remote IP.

How do we collect your data?

Most of the data we collect is provided directly by you to nomos system AG. We collect and process data when you:

  • use the website
  • register for a nomos cloud account or link your account to nomos controller.
  • use remote access
  • activate push notifications
  • activate controller crash and usage diagnostics

How will we use your data?

nomos system AG collects your data so that we can:

  • create and manage your nomos cloud account
  • link your account to devices and services such as Alexa, IFTTT, Google Assistant
  • improve our services through crash and usage diagnostics

How do we store your data?

For better security, nomos usually stores your data on your local controller and device. Data such as email, first name, last name and other personal data is stored securely online.

For security reasons and to protect the transmission of confidential content, such as requests that you send to us as the site operator, the website uses SSL/TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data that you transmit to us cannot be read by third parties.

In the case of activated push notification, AWS stores device tokens, which are, however, all anonymized and cannot be assigned to personal data.

Privacy policies of other websites and services

The nomos system AG website contains links to other websites. Our privacy policy applies only to our website. If you click on a link to another website, you should read their privacy policy.

Google reCAPTCHA

This website uses the reCAPTCHA service provided by Google Ireland Limited (Gordon House, Barrow Street Dublin 4, Ireland “Google”). The query is used to determine whether the input is made by a human or by automated, machine processing. The query includes sending the IP address and any other data required by Google for the reCAPTCHA service to Google. For this purpose, your input will be transmitted to Google and used there. However, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before this happens. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there. Google will use this information on behalf of the operator of this website to evaluate your use of the service. The IP address provided by reCaptcha as part of reCaptcha will not be merged with any other data provided by Google. Your data may also be transmitted to the USA. The European Commission’s “Privacy Shield” is an adequacy decision for data transfers to the USA. Google participates in the “Privacy Shield” and has submitted to its requirements. By activating the query, you consent to the processing of your data. The processing is carried out on the basis of Art. 6 (1) lit. a GDPR with your consent. You can revoke your consent at any time without affecting the legality of the processing carried out with your consent up to the revocation. For more information about Google reCAPTCHA and the associated privacy policy, please visit: https://policies.google.com/privacy?hl=de

Google Analytics

This website uses Google Analytics, a web analysis service provided by Google Ireland Limited. If the data controller for this website is located outside the European Economic Area or Switzerland, Google Analytics data processing is carried out by Google LLC. Google LLC and Google Ireland Limited are hereinafter referred to as “Google”.

The statistics obtained help us to improve our offering and make it more interesting for you as a user. This website also uses Google Analytics for a cross-device analysis of visitor flows, which is carried out via a user ID. If you have a Google user account, you can disable the cross-device analysis of your usage in the settings there under “My data”, “Personal data”.

The legal basis for the use of Google Analytics is Art. 6 (1) sentence 1 f) GDPR. The IP address transmitted by your browser in the context of Google Analytics is not associated with any other data held by Google. We would like to point out that on this website Google Analytics has been extended by the code “_anonymizeIp();” in order to ensure an anonymized collection of IP addresses. This means that IP addresses are further processed in abbreviated form, thus excluding the possibility of personal references. Insofar as the data collected about you is personally identifiable, this is therefore immediately excluded and the personal data is thus promptly deleted.

Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there. Google will use this information on behalf of the operator of this website to evaluate your use of the website, to compile reports on website activity, and to provide other services regarding website activity and Internet usage for the website operator. For the exceptional cases in which personal data is transmitted to the United States, Google has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.

Google Analytics uses cookies. The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States. You may refuse the use of cookies by selecting the appropriate settings on your browser, however, please note that if you do this you may not be able to use the full functionality of this website. You can also prevent the data generated by cookies about your use of the website (incl. your IP address) from being passed to Google, and the processing of these data by Google, by downloading and installing the browser plugin available at the following link: Disable Google Analytics.

You can also prevent the use of Google Analytics by clicking on this link: Disable Google Analytics. This stores an opt-out cookie on your device that prevents the processing of personal data by Google Analytics. Please note that if you delete all cookies on your device, these opt-out cookies will also be deleted, i.e. you will have to set the opt-out cookies again if you wish to continue to prevent this form of data collection. The opt-out cookies are set per browser and computer/end device and must therefore be activated separately for each browser, computer or other end device.

LinkedIn

We use the marketing services of the social network LinkedIn, LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland (“LinkedIn”) within our online offering.

These use cookies, which are text files placed on your computer, to help the website analyze how users use the site. For example, we can measure the success of our ads and show users products they have previously shown an interest in.

The information collected includes, for example, the operating system and browser, the website you previously visited (referrer URL), which pages the user has visited, which offers the user has clicked on, and the date and time of your visit to our website.

The information generated by the cookie about your use of the website will be transmitted and stored by LinkedIn on servers in the United States. LinkedIn does not store the name or email address of the respective user. Rather, the above data is only assigned to the person for whom the cookie was generated. This does not apply if the user has allowed LinkedIn to process the data without pseudonymization or has a LinkedIn account.

You can prevent the storage of cookies by selecting the appropriate settings on your browser; however, please note that if you do this you may not be able to use the full functionality of this website. You can also object to the use of your data directly at LinkedIn: https://www.linkedin.com/psettings/guest-controls/retargeting-opt-out.

We use LinkedIn Analytics to analyze and regularly improve the use of our website. The statistics obtained enable us to improve our offering and make it more interesting for you as a user. All LinkedIn companies have adopted the standard contractual clauses to ensure that the data traffic to the USA and Singapore necessary for the development, implementation and maintenance of the services takes place in a lawful manner. Insofar as we ask users for their consent, the legal basis for the processing is Art. 6 para. 1 lit. a GDPR. Otherwise, the legal basis for the use of LinkedIn Analytics is Art. 6 para. 1 sentence 1 lit. f GDPR.

Contractual services

We process the data of our contractual partners and interested parties, as well as other clients, customers, clients, clients or contractual partners (uniformly referred to as “contractual partners”) in accordance with the data protection regulations of the federal government (Data Protection Act, DSG) and the EU-DSGVO in accordance with Art. 6 para. 1 lit. b. DSGVO, in order to provide them with our contractual or pre-contractual services. The data processed, the type, scope, purpose and necessity of their processing are determined by the underlying contractual relationship.

The processed data includes the master data of our contractual partners (e.g. names and addresses), contact data (e.g. email addresses and telephone numbers) as well as contract data (e.g. services used, contract contents, contractual communication, names of contact persons) and payment data (e.g. bank details, payment history).

We do not process any special categories of personal data, unless these are part of a commissioned or contractual processing.

We process data that is necessary for the justification and fulfillment of the contractual services and point out the necessity of their disclosure, insofar as this is not evident to the contractual partners. Disclosure to external persons or companies only takes place if it is required under a contract. When processing the data provided to us in the context of an order, we act in accordance with the instructions of the client and the legal requirements.

When using our online services, we may store the IP address and the time of the respective user action. The storage is based on our legitimate interests, as well as the interests of users in protection against misuse and other unauthorized use. In principle, this data is not passed on to third parties, unless it is necessary to pursue our claims in accordance with Art. 6 para. 1 lit. f. DSGVO or there is a legal obligation in accordance with Art. 6 para. 1 lit. c. DSGVO.

The data will be deleted when it is no longer required for the fulfillment of contractual or statutory duties of care and for dealing with any warranty and comparable obligations, whereby the necessity of storing the data is reviewed at irregular intervals. In all other respects, the statutory retention requirements apply.

Note on data transfer to the USA

Among other things, our website includes tools from companies based in the United States. When these tools are active, your personal data may be transferred to the US servers of the respective companies. We would like to point out that the USA is not a safe third country within the meaning of EU data protection law. US companies are obliged to release personal data to security authorities without you as the data subject being able to take legal action against this. It therefore cannot be ruled out that US authorities (e.g. secret services) may process, evaluate and permanently store your data on US servers for monitoring purposes. We have no influence over these processing activities.
